Halle Berry is seeking sole custody of her son with ex Olivier Martinez.
Berry is seeking a change in court orders due to Respondent's ongoing violations, unilateral decision making, and interference with the child's best interests.
Berry acknowledges in the filing that she is not flawless, but she is constantly striving to put Maceo's, her 10-year-old son, best interests first.
The filing claims that Martinez's "troubled and harmful behavior" towards interventions for their son's educational and therapeutic needs has negatively affected their relationship with Berry.
Martinez has allegedly interfered with Maceo's educational and psychiatric assessments, including tutoring, using soccer as a bargaining chip in custody negotiations, dismissing therapy for the 10-year-old, and not adhering to custodial time agreements.
"The filing states that Martinez's actions and lack of cooperation with respect to Maceo's psychological and educational needs have been detrimental to Maceo's health and welfare. Additionally, the filing alleges that Martinez's refusal to allow early interventions has caused Maceo to fall further behind in school, caused Maceo's acting out behaviors to worsen, and caused further damage to Maceo's and Petitioner's relationship."
It is alleged that Martinez has been discussing the custody battle with their son, which is against the terms of their original divorce agreement.
Maceo was not immune to Berry's behavior, which worsened over time as Berry refused therapeutic intervention for Maceo. Maceo acted out upon his return from his father's allegedly becoming increasingly angry and combative toward Berry, which worsened with longer periods in his father's custody, Berry claimed.

Before receiving therapeutic intervention, Maceo frequently sided with Respondent in private disputes that Petitioner did not discuss with him, providing instructions on how they would resolve the issue, without considering Petitioner's input or authority as a parent, according to the filing.
Berry and Martinez's representatives did not promptly respond to Planet Chronicle Digital's request for comment.
The actress, who finalized her divorce from Martinez last year after an eight-year court battle, is required to pay nearly $8,000 in monthly child support for their son, Maceo, as per court documents obtained by Planet Chronicle Digital. Additionally, she is obligated to pay Martinez 4.3% on any income she earns above $2 million, and is responsible for their son's private school tuition, all extracurricular activities, and healthcare.
According to the divorce decree, Martinez must take "reasonable steps" to secure employment and provide financial support for Maceo.
Maceo instructed Berry and Martinez to avoid criticizing each other in his presence.
Berry's new filing emphasizes that "the parties must be explicitly prohibited and restricted from discussing their individual perspectives on child custody matters or the details of these proceedings with Maceo."
