Harvey Weinstein will be arraigned on a new indictment with up to three additional sex offenses on Wednesday in Manhattan, his lawyer announced.
Arthur Aidala, Weinstein's lawyer, announced that the ex-movie mogul will appear in court in person to tackle his latest legal challenge, following his excusal from a hearing last week due to emergency heart surgery.
At a hearing on September 12th, Manhattan District Attorney Alvin Bragg's office announced that a grand jury had indicted Weinstein for new, uncharged offenses.
The indictment against Weinstein will be kept under seal until he is arraigned. Prosecutors have stated that the grand jury heard evidence of up to three alleged assaults, including one at the Tribeca Grand Hotel, another at a Lower Manhattan residential building, and a third at a Tribeca hotel in May 2016.
Weinstein is awaiting retrial in his landmark #MeToo case after New York's highest court reversed his 2020 conviction earlier this year.
The retrial of Weinstein, scheduled for November 12th, will see prosecutors attempt to incorporate new charges into the proceedings, a move opposed by Weinstein's legal team who argue that the case should be heard separately.
Last week, Aidala stated that due to the indictment being under seal, it is unclear whether the new charges involve some or all of the additional allegations presented to the grand jury.
"He stated outside court last week that we have no information on the specific accusations, locations, or timing."
Weinstein has long maintained that any sexual activity was consensual.
Since September 9, he has been undergoing emergency surgery at a Manhattan hospital to remove fluid from around his heart and lungs.
Last week, a judge decided to permit Weinstein, 72, to remain in the Bellevue Hospital prison ward indefinitely rather than being transferred back to the infirmary ward at Rikers Island jail complex.
In April, New York's Court of Appeals ruled that the trial judge unfairly allowed testimony against Weinstein based on allegations from other women that were not part of the case, resulting in the vacating of his conviction and the ordering of a new trial.
Weinstein, once a prominent figure in Hollywood, founded and co-founded production companies such as Miramax and The Weinstein Company, producing films including "Shakespeare in Love" and "The Crying Game."
