A Texas officer who was exonerated of a dropped rape charge is now suing his former department.

An allegation of rape against a Texas police officer has been exonerated, but he is suing investigators for ignoring evidence that could have cleared him.
Freddie Douglas, an officer, was arrested in December on charges of raping his girlfriend, who was the girlfriend of one of his longtime friends. However, the charges were eventually dropped, and Douglas is now suing the police, arguing that they were aware of evidence that would have exonerated the two men but refused to investigate and proceeded with the arrests.
Amanda Zawieruszynski, the girlfriend named in the complaint, alleged that both Douglas and her boyfriend, John Marks, raped her at Marks' home on November 8, 2023. The complaint stated that she tried to fight Marks off, but he pushed her over to Douglas, who had sex with her while she was trying to fight him off. Marks and Douglas were arrested in December, and Marks immediately protested that surveillance footage from inside his home would contradict the accusation.
Attorney Mike Kerensky filed a lawsuit stating that both men had sex with Zawieruszynski, but it was entirely consensual.
At John Marks' home, Douglas first met AZ [Zawieruszynski] on the day before Freddie Douglas' birthday. They had planned to attend a Rockets game that night, and Zawieruszynski texted Marks several times to arrange a meeting with them after the game.
The lawsuit claims that Zawieruszynski visited the house and the three consumed some drinks, but no one got drunk.
John Marks and AZ had consensual sex in the pool at some point. Later, AZ wanted to have consensual sex with Freddie Douglas and did.
A month later, Zawieruszynski visited the Manvel Police Department and alleged that she had been raped by two men.
Despite attempts to contact Zawieruszynski, who is also named in the lawsuit, Planet Chronicle Digital was unable to reach him.
On Dec. 7, Douglas's chief informed him that the MPD were arresting him, despite his immediate notification to the arresting officers that the footage from inside Marks' home would clear him.
The lawsuit alleges that other MPD officers were present at Marks' home and discussed the footage, but they did not investigate it.
Planet Chronicle Digital obtained footage from Marks' front door camera showing police officers discussing the footage. One officer stated that Douglas and Marks had mentioned it during their arrests, while another pondered if Zawieruszynski had given consent.
An officer noticed the door camera a few minutes later and moved away, stating that it would be recording them.
According to Douglas' lawsuit, the Manvel Police Department knew within minutes of his arrest that there was objective evidence to determine which of them was being truthful, AZ or Douglas and Marks.
MPD Chief Keith Taylor contested the lawsuit's version of events, stating that there has been misinformation provided to news outlets by the individuals and their attorneys.
Although he couldn't discuss the specifics of the case because of pending litigation, he stated that it was false that MPD investigators intentionally ignored evidence that would have cleared Marks and Douglas.
Taylor stated that the claim was false because evidence was presented to the district attorney's office and Grand Jury, as required by law. Exculpatory evidence was also presented. Through the legal process, it will be proven that the claims and allegations are false.
The charges against Douglas and Marks were dropped after the Brazoria County district attorney's office received information that Manvel police never approached them about the case.
Despite the MPD's persistence in the case, the DA ultimately dismissed the charges after a grand jury convened.
