A California judge has prohibited a school district from enforcing a policy that mandated teachers and staff to inform parents if their student disclosed a desire to alter their name or pronouns.
Last year, San Bernadino County Judge Michael Sachs issued a preliminary injunction against the policy, and now the court has formally struck down most of the plan. However, the judge allowed part of the policy that required parental notification if a student's name or pronoun is formally changed in the school's records.
Over a month after California Gov. Gavin Newsom signed legislation prohibiting schools from implementing notification requirements in July, a ruling was issued.
LGBTQ+ advocacy groups commended AB 1955 for its potential to safeguard transgender and gender-nonconforming students residing in hostile households.
The legislation, according to Tony Hoang, executive director of Equality California, is "essential" for enhancing safeguards for LGBTQ+ youth against parental notification laws.
The law violates parents' rights, according to the conservative California Family Council.
"This bill threatens the fundamental role of parents and puts boys and girls at risk," said Jonathan Keller, the council's president, in a statement. "Moms and dads have a constitutional and divine obligation to guide and protect their children, and AB 1955 violates this sacred duty."
The new law was enacted following the implementation of policies in several California school districts that mandated parents to be informed if a student wished to alter their gender identification. This move sparked opposition from Democratic state officials, who contend that students should be shielded from their parents' knowledge about their gender identity.
