Prosecutor: Man who fired in self-defense during deadly Lions tailgating shooting will not be charged.
Two individuals, Jalen Welch and Rayshawn Palmer, were fatally shot by the same bullet.
The shooter at the popular tailgating site following the Detroit Lions game on Sunday acted in self-defense, and as a result, prosecutors in Michigan will not file charges.
On Sunday afternoon, Jalen Welch, 25, and Rayshawn Palmer, 40, were killed in a "physical altercation" near Shed 6 in Eastern Market, according to the Wayne County Prosecutor's Office.
The unidentified 40-year-old shooter was allegedly confronted by Welch, who displayed a pistol in a "threatening manner" during the argument between five men that followed the fight.
The shooter, who possessed a concealed pistol license, fired his weapon and hit Welch and Palmer both in the head with the same bullet.
"Two people were killed by a single gunshot, with Mr. Palmer being an innocent bystander who was not involved in the fight," the press release stated. "According to evidence, Mr. Palmer was attempting to de-escalate the situation and prevent the argument from escalating."
Welch was also a concealed pistol license holder.
"We have meticulously examined this case and have determined it to be an instance of lawful self-defense. Unfortunately, during the festivities at a Lions tailgate, two individuals tragically lost their lives. The first victim was Mr. Welch, who drew a gun and was subsequently shot by the 40-year-old, a legally licensed CPL holder, who was defending himself. A single bullet was fired," stated Wayne County Prosecutor Kym Worthy in a statement.
"The most heartbreaking aspect is that an innocent bystander, Mr. Palmer, was shot and killed with the same bullet that passed through Mr. Welch's head. It could have been any one of us. Despite examining all applicable laws, no crime can be charged and proven beyond a reasonable doubt."
Palmer was declared dead at the scene, while Welch was transported to a hospital and pronounced dead the next day.
Officials said the shooter had not been involved in the physical altercation.
