A judge has rejected former President Trump's bid to transfer his New York hush money case from state to federal court, citing a U.S. Supreme Court ruling on presidential immunity.
Judge Alvin Hellerstein of the U.S. District Court stated that the high court's ruling on presidential immunity did not change his belief that payments made to an adult film star are not connected to a president's official duties.
Trump's reimbursement to Cohen for hush money payments to Stormy Daniels were not official acts he made as president, according to what he previously said.
"Despite whether the burden falls on the People or Mr. Trump, my conclusion that I received hush money reimbursement remains unchanged. The Supreme Court's decision does not affect my previous conclusion that the payments were private and unofficial acts beyond executive authority."
The Supreme Court's 2023 ruling limits prosecutors' ability to use official acts as evidence against a president for unofficial actions that were illegal. Trump's legal team contends that jurors in the hush money case should not have heard testimony from former White House staffers describing the then-president's reaction to news coverage of the Daniels deal.
In May, Trump was found guilty of 34 counts of falsifying business records to hide a 2016 deal to pay off Daniels to keep quiet about their alleged 2006 sexual encounter. Prosecutors claimed that the payment was part of an attempt to conceal damaging information about him during his first presidential campaign.
Trump has denied the allegations and portrayed his prosecution as a political witch hunt aimed at harming his current presidential campaign.
"According to a statement from Trump campaign spokesperson Steven Cheung to Planet Chronicle Digital, there should be no sentencing in the Election Interference Witch Hunt. As per the United States Supreme Court, this case, along with all other Harris-Biden Hoaxes, should be dismissed. President Trump and his legal team will continue to fight to move this Hoax into federal court where it should be put out of its misery once and for all."
Trump accused New York Judge Juan Merchan of having a conflict of interest and being biased against him, citing Merchan's daughter, Loren Merchan, who supports Democratic political candidates.
Alvin Bragg, the Manhattan District Attorney, wrote to Merchan on August 30th, stating that Trump's request to transfer his New York criminal case to federal court should be postponed until the judge makes a decision on the motion to vacate due to presidential immunity and the request to delay sentencing.
The letter notes that the defendant's concerns about timing are a result of his strategic and dilatory litigation tactics.
Merchan is expected to rule on the motion on Sept. 16.
