ICE apprehends migrant charged with violent offenses despite Massachusetts court's refusal to uphold detainer.
In recent weeks, several individuals with a history of sexual offenses and suspected gang affiliation have been apprehended by ICE Boston.
In Massachusetts, a migrant who had been residing in the U.S. unlawfully for almost two years was apprehended by Immigration and Customs Enforcement (ICE).
On Nov. 18, ICE agents arrested Julio Esteban Batista-Castillo, 24, in Boston and charged him with kidnapping, malicious destruction of property, breaking and entering, home invasion, and several assault and battery charges.
An ICE press release from Tuesday stated that the suspect entered the United States unlawfully in January 2023.
The Roxbury District Court did not honor an immigration detainer for Batista-Castillo, who was subsequently taken into ICE custody by Enforcement and Removal Operations (ERO) Boston acting Field Office Director Patricia Hyde.
"Hyde stated that Batista has been accused of serious crimes, including assault and battery with strangulation and a firearm, and should not be released into the community."
The court put the Boston community at risk by not retaining Hyde.
"Unfortunately, despite the Roxbury District Court receiving a detainer request from ERO Boston to hold the individual in custody for a brief period, allowing officers to arrest him safely, the detainer was not honored, putting the community and officers at risk."
ICE Boston has apprehended numerous violent migrants, including Belardis Tapia Gonzalez, an MS-13 gang member accused of child molestation, in Lynn, Massachusetts on Nov. 18.
In October, ICE officials arrested another suspected child predator, Mateo Hincapie Cardona, in Boston. He was charged with enticing a child under 16, distributing obscene matter, and lasciviously posing and exhibiting a child in the nude.
