ICE apprehended a migrant who was accused of committing sex crimes against a child after a detainer request was ignored.
A 45-year-old man, Felix Meletz Guarcas, has been accused of multiple sexual assaults on a child, according to immigration authorities.
An undocumented man from Guatemala, who had been residing in the US illegally, was apprehended by immigration officials last month in Rhode Island for allegedly molesting a child.
Felix Meletz Guarcas, 45, was released from the Rhode Island Department of Corrections despite an immigration detainer request from U.S. Immigration and Customs Enforcement to hold him until federal authorities could take him into custody, ICE stated.
An illegal migrant suspect will be taken into custody by federal authorities when local authorities notify immigration agents of their impending release, in order to initiate deportation proceedings.
"ERO Boston acting Field Office Director Patricia Hyde stated that immigration detainers are used as public safety tools, but the Rhode Island Department of Corrections released Meletz Guarcas to home confinement despite ERO's request to hold him in their facility."
The Department of Corrections does not release information on home confinement, so our officers were forced to arrest him in a public parking lot in Cranston instead of a controlled environment in a custodial setting.
ICE stated that Meletz Guarcas entered the U.S. illegally.
On February 16, 2022, the Pawtucket Police Department in Rhode Island arrested him for misdemeanor disorderly conduct and felony assault of police officers and other officials. He was found guilty and received six months of probation as punishment.
On November 20th, Meletz Guarcas was arrested once more and accused of first-degree sexual assault on a child and five counts of second-degree sexual assault on a child, according to ICE.
The incident occurred on Sept. 3, authorities said.
Meletz Guarcas remains in ICE custody and the charges against him are pending.
