Federal judge's son admits to recording sexual acts and could escape imprisonment.
Over 150 DVDs and three hard drives were confiscated from Daniel McAvoy, the son of Judge Thomas McAvoy by authorities.
A federal judge's 51-year-old son pleaded guilty to secretly filming sex acts with multiple women over several years. However, he may avoid jail time if he participates in a program that aims to identify the underlying causes of his criminal behavior.
Daniel McAvoy, a resident of Manhattan, pleaded guilty to seven charges of illegal surveillance in state court after being accused of secretly recording four women undressing or engaging in sexual acts with him on multiple occasions, as reported by Gothamist, citing the Manhattan District Attorney's Office.
The women in the sexual encounters were unaware that they were being recorded.
Danielle Turcotte, the Assistant District Attorney, stated that although McAvoy had recorded numerous additional women, the statute of limitations had expired in those cases.
Reports indicate that investigators confiscated three hard drives and over 150 DVDs from the residence of Thomas McAvoy, a senior judge in Binghamton, New York, who was appointed to the position by former President Ronald Reagan in 1986.
The report stated that the DVDs had labels with women's names and pornographic terms. Investigators found these DVDs in the judge's home after receiving a tip from McAvoy's girlfriend. He was indicted in 2022 for 29 counts of unlawful surveillance.
Gothamist reports that McAvoy is participating in Manhattan's Felony Alternative to Incarceration (ATI) Court, a program that provides alternatives to incarceration for all types of felony cases, including violent offenses and sex offenses, with the goal of addressing the underlying issues that contribute to criminal behavior.
The defendant's open plea was made possible by his attorneys, who called for it after his attendance in the program.
The District Attorney's Office is recommending a prison sentence instead of accepting the plea.
"According to Gothamist, Turcotte, a man over 50 years old, claims to have a master's degree and is self-employed with sufficient resources. However, he repeatedly violated the trust of his sexual partners over the past 15 years for selfish reasons, without any regard for the women involved."
One of McAvoy's victims criticized the decision to consider his plea, stating that he remains a danger to women.
The open plea fails the victims who bravely spoke out, those who are still unaware they were filmed without consent, and unfortunately, other women who may also experience the same fate, as she told Gothamist.
In August, McAvoy's ex-girlfriend, with whom he had an on-again, off-again relationship for a decade, filed a civil lawsuit against him, as reported by the New York Post.
The mother of two was unaware that she was being recorded during their sexual relationship until months after the breakup, when the Manhattan District Attorney's office presented her with a clip, as stated in the lawsuit.
According to the lawsuit, Daniel McAvoy engaged in a premeditated plot to secretly record hundreds of sexual encounters with women he had lured to his home over many years.
Jane Doe, identified only as the woman, stated in the lawsuit that she meticulously stored and cataloged unlawful sex videos depicting her victims, and occasionally shared these unlawful sex videos with others.
The revelation that a man she had trusted for years was secretly recording her most intimate moments has left Jane Doe's life in shambles, according to her legal filing.
She stated that she was bringing the case to obtain a degree of personal justice.
