The couple in Arizona, who were devoted to Disneyland in California, lost their lawsuit against the exclusive Club 33.
In 2021, a civil court in Orange County ruled against Scott and Diana Anderson of Gilbert, who had sued Walt Disney Parks and Resorts after Scott was expelled from Club 33 in 2017 due to public intoxication, which he has consistently denied.
Scott and his wife are determined to challenge the outcome of their case and will do so until the end. They intend to file an appeal.
"My retirement has been delayed by five years," he said to the outlet. "I'm paying an exorbitant amount. Each day, I'm receiving another invoice, and I'm on the brink of collapse."
Diana is ready to take more drastic action.
"She told The Times that she would sell a kidney and didn't care."
On the evening of Sept. 3, 2017, Scott consumed two to three drinks at Club 33, a somewhat secretive club that provides fine dining, souvenirs, and tailored experiences for its members at Disneyland or within different park attractions.
According to The Times, Sean Macias, Mr. Anderson's attorney, stated during court arguments that they have not proven that Mr. Anderson was intoxicated.
Scott's behavior that evening, characterized by slurred speech and swaying, was caused by a vestibular migraine, and no Breathalyzer or blood test was conducted by authorities that night.
Last year, Diana was temporarily suspended from Club 33 due to the use of inappropriate language, according to The Times.
Disney lawyer Jonathan Phillips contended that the Andersons "did not want to face the repercussions of not adhering to the rules," and Scott "denied his wife of 40 years her lifelong aspiration to enter Club 33."
The Andersons' annual Disneyland expenses totaled nearly $125,000, including their $31,500 Club 33 membership, travel, hotels, and passes. However, their lawsuit expenses amounted to approximately $400,000.
