A convicted sex offender was released by a local jurisdiction despite three immigration detainers.
An illegal migrant from Bolivia was apprehended in Virginia by ICE agents following a series of alleged sexual offenses against kids.
In Annandale, Virginia, on August 19, the Enforcement and Removal Operations (ERO) in Washington, D.C. captured 36-year-old Jose Fabricio Veizaga-Vargas.
In April 2023, a migrant from Bolivia illegally entered the U.S. through Texas and was caught and released. ERO later noted that Veizaga was given a notice to appear before a Department of Justice immigration judge at a later date.
In Virginia, a 36-year-old was classified as a convicted sex offender following an assault on a child.
"ERO Washington, D.C., Field Office Director Liana Castano stated that Jose Fabricio Veizaga-Vargas, a convicted sex offender, poses a significant threat to the safety of children in Northern Virginia. As such, ERO Washington, D.C., will continue to prioritize public safety by arresting and removing egregious noncitizen offenders from our Washington, D.C., and Virginia neighborhoods."
This month, he was also accused of seven counts of possessing child porn and obscene material involving a minor.
According to ERO, he was sentenced to six months in jail following his conviction, but the court suspended his sentence.
The Fairfax County Adult Detention Center did not comply with an immigration detainer and released Veizaga from custody without informing the ERO.
On August 15, Veizaga was arrested by Fairfax County Police and charged with seven counts of felony possession of child pornography and felony possession of obscene material with a minor.
The Fairfax County Adult Detention Center again refused to honor an immigration detainer filed by ERO Washington, D.C., after Veizaga's arrest, resulting in his release.
On August 19th, the Fugitive Operations Team of ERO Washington, D.C. apprehended Veizaga in Annandale.
Veizaga remains in the custody of ERO Washington, D.C., as a notice of custody determination was served upon him.
Washington, D.C., is classified as a "sanctuary" city, meaning it does not collaborate with ICE detainers under policy.
If an illegal immigrant is arrested on criminal charges and deemed removable by ICE, a detainer will be filed, requesting ICE's notification before the immigrant is released from custody.
Immigrants in sanctuary jurisdictions are not typically held in detention, with some arguing that it is not their responsibility and that doing so could harm community relations.
ICE's website warns that when law enforcement agencies do not honor immigration detainers and release serious criminal offenders, it weakens their ability to safeguard the public and fulfill their mission.
