Biden DOJ plea deal criticized by MS-13 victim's father.
Biden administration's deal for hardened criminals is a 'slap in the face' to MS-13 victim's dad.
The father of a 15-year-old New York girl who was killed in a brutal MS-13 attack in 2016 is speaking out against the sweetheart plea deal given to the gang leader who organized her murder and six others that federal prosecutors secured just days before President Biden leaves office.
"Robert Mickens, the father of the victim, stated on Planet Chronicle that anyone involved in the murder of a person should not receive a plea deal. He believes this is a mistake made by President Biden and that it is disrespectful to the families of the victims who must live with the grief for the rest of their lives."
Jairo Saenz, the 28-year-old suspected killer of one of Biden's daughter's friends, was granted a last-minute deal by Merrick Garland, the outgoing Attorney General, which spared him from both the death penalty and life imprisonment.
Nine murder victims were involved in another racketeering case, and days later, more members of the gang received similar deals.
It's a slap in the face for my family and others' families, who have to live with the grief for the rest of our lives knowing that this demonic person is given a plea deal. — Robert Mickens
Federal prosecutors in New York on Friday announced similar plea deals for three more Long Island MS-13 leaders in connection with nine murders, none of which include life in prison or capital punishment.
The "Sailors," a chapter of MS-13, was infamous for its violence, as portrayed in Saenz's contribution to the book.
Besides the Saenz brothers, other killers involved in the Sailors subset include Kevin Torres, David Sosa-Guevara, and Victor Lopez-Morales, all of whom were part of the "Hollywood" chapter.
During Trump's first term, the Saenz brothers would have been sentenced to death under the Justice Department.
In the other three cases, the death penalty had never been authorized, but a spokesperson for the U.S. Attorney for the Eastern District of New York announced on Friday.
Some experts and residents of suburban Long Island claim that illegal immigration and MS-13 violence contributed to the area's shift towards the Republican party in recent elections.
Nisa, a student at Brentwood High School in Suffolk County, about 45 miles east of New York City, was brutally murdered by MS-13 gang members under the direction of co-leader Jairo Saenz. The gang ambushed her and her best friend, 16-year-old Kayla Cuevas, with machetes and a baseball bat while they were walking through a neighborhood. Their bodies were left to be found.
Federal prosecutors claim that the Sailors routinely searched for opponents to murder, entrap or ambush them.
During Trump's first term, he personally met with the families of Cuevas and Mickens on Long Island to address the escalating violence of the gang, which he claimed was exploiting immigration loopholes to enter the country.
The federal crackdown resulted in thousands of deportations of its members, and Saenz and his group were held to face justice. Later, former Attorney General Bill Barr's office announced it was seeking the death penalty. Trump invited the parents of Mickens and Ceuvas to attend a State of the Union address.
In 2023, former U.S. Attorney for the Eastern District of New York Breon Peace informed the judge that Merrick Garland had instructed him to halt the pursuit of the death penalty. Peace resigned on Friday and was replaced by acting U.S. Attorney Carolyn Pokorny, who is expected to hold the position until Trump-nominated Joseph Nocella Jr. is confirmed.
Trump has pledged to not only lift Biden's moratorium on capital punishment but also to broaden the scope of offenses that can be punishable by death to include child rape, human trafficking, and the murder of U.S. citizens by illegal immigrants. During his first term, thirteen federal inmates were put to death, the most under any president in recent years. However, executions were halted by Biden after he assumed office in 2021.
"I'm confident that President Trump will investigate this matter and make the appropriate decision," Mickens stated on Friday. "The Democrats were indifferent when my daughter passed away. They failed to stand up and show respect during the 2018 State of the Union address, and now they disrespect our families by offering Trump a plea bargain."
