Garth Brooks' judge temporarily halts effort to dismiss sexual assault lawsuit: documents
In 2019, a former makeup artist accused Garth Brooks of raping her during a work trip.
According to documents obtained by Planet Chronicle Digital, a judge rejected Garth Brooks' request to dismiss a sexual assault lawsuit brought against him by a former makeup artist.
U.S. District Judge Michael Fitzgerald upheld the complaint filed in the central district of California against Brooks, stating that an "original action" still pending in another state does not negate the validity of the complaint. The court date originally scheduled for Monday, Dec. 16 was vacated due to the judge's ruling on Dec. 11.
In September, a 62-year-old man named Brooks filed a lawsuit in Mississippi, allegedly trying to prevent a lawsuit by "Jane Roe," according to a complaint obtained by Planet Chronicle Digital. In the document, filed under "John Doe," Brooks denied the woman's claims that he had raped her in 2019.
The judge decided to put the California case on hold for 10 days to obtain additional details about the Mississippi case, as requested by the "Friends in Low Places" singer, who resides in Mississippi.
The Court has decided that the most suitable course of action is to let the Mississippi court decide Plaintiff's equitable claims in the initial instance, as stated in the documents.
Planet Chronicle Digital did not receive an immediate response from Brooks' representatives.

Brooks was accused of assault and battery by his former makeup artist, who claimed that he openly discussed sex in front of her, exposed his genitals, shared sexual fantasies with her, sent her explicit messages, and physically groped her breasts.
According to the lawsuit, she claimed that Brooks raped her during a work trip to Los Angeles in 2019, while on a Grammys tribute to R&B singer Sam Moore.
"Jane Roe" asserted that they had only one room reserved for both of them to occupy.
"Suddenly, Brooks emerged from the bedroom doorway, completely naked. He flexed his muscles, causing Ms. Roe to instantly feel a nauseating sensation in her stomach. She knew she was trapped in the room alone with Brooks, far away from help in Nashville."
The alleged rape in 2019 led to an increase in the frequency of sexually charged actions, according to the makeup artist's claim.
According to the complaint, Ms. Roe alleges that Brooks increased the frequency of his sexually charged conversations with her, which included his repeated comments about having a threesome with his wife (Trisha Yearwood) in which he implied that Ms. Roe would be the third person. Ms. Roe also claims that Brooks’ wife overheard these comments on at least one occasion.
The singer of "Thunder Rolls" has denied the accusations and modified his lawsuit against "Jane Roe" in an October filing obtained by Planet Chronicle Digital. In the filing, he accused the woman of attempting extortion, defamation, false light invasion of privacy, and intentional infliction of emotional distress.
""I have been subjected to threats, lies, and dire predictions about my future for the past two months, which felt like a loaded gun being pointed at me," Brooks stated in a Planet Chronicle Digital interview."
"No matter the amount, hush money is still hush money. In my view, that implies I am acknowledging actions I am unable to perform—unpleasant deeds that no person should ever inflict on another. We filed a lawsuit against this individual almost a month ago to address extortion and character defamation. We did so anonymously to protect the families involved."
