Days after a Hamptons outing, Alec Baldwin files a new demand to dismiss involuntary manslaughter charge.
If convicted of involuntary manslaughter, Alec Baldwin, known for his role in 'Rust,' could face up to 18 months in prison.
On Monday, Alec Baldwin filed a new motion to dismiss his involuntary manslaughter charge, as reported by Planet Chronicle Digital.
The actor, who has won an Emmy Award, filed his fifth request to have the charges dropped, but was denied during a virtual hearing on Friday.
Until at least Friday, June 28, Judge Mary Marlowe Sommer refused to issue a ruling on Baldwin's request to dismiss charges due to destruction of evidence.
Despite not appearing in virtual hearings, Baldwin was seen in The Hamptons over the weekend. He had previously filed court paperwork to waive all his future pre-trial appearances.
Baldwin's legal team filed an expedited motion for relief, requesting an order to dismiss the indictment with prejudice. They argued that the state violated discovery obligations by not promptly disclosing "favorable evidence" that would have significantly altered Baldwin's trial preparation.
"The State's strategy of trial by ambush is grossly prejudicial and abhorred by courts, as stated in documents. The reason for this is clear: Baldwin has had to divert substantial time and resources just to pursue the growing list of undisclosed discovery that continues to emerge from hiding. Additionally, the time it takes to review more than 150,000 pages of documents and countless hours of audio recordings and videos that have been dumped on Baldwin just weeks before trial is significant. Furthermore, most of the State's late disclosures were made after the dispositive motion and witness deadline, which demonstrates how seriously Baldwin has been prejudiced by the State's misconduct."
Just like any other criminal defendant, Baldwin should be treated fairly, and both federal and state laws indicate dismissal.
During a hearing on Friday, Judge Mary Marlowe Sommer rejected Baldwin's request for dismissal. Despite the prosecution's failure to prove that Baldwin committed a crime, Baldwin's legal team argued that the prosecution's case was weak. They pointed out that the prosecution had admitted that the "prospect of live ammunition" being present on the "Rust" set was "incomprehensible."
Sommer rejected the argument after an hours-long hearing.
In March, Hannah Gutierrez Reed was convicted of involuntary manslaughter for the "Rust" armorer's role in the Western film set shooting that killed cinematographer Halyna Hutchins. Gutierrez Reed was also found not guilty of evidence tampering in 2023, after being accused of passing off a bag of cocaine on the day of the fatal set shooting.
On January 19, Baldwin was indicted on two charges: involuntary manslaughter or, alternatively, negligent use of a firearm without due caution or circumspection. The incident occurred on October 21, 2021, when a gun Baldwin was holding discharged on the Western film set, resulting in the death of Hutchins.
Next month, he will be tried in court for nearly two weeks and could receive up to 18 months in prison if found guilty.
In recent weeks, Baldwin revealed that his family was venturing into the world of reality television with their own TLC show, set to debut in 2025.
The Baldwins is a show that will depict the highs and lows, the positive and negative, the exciting and chaotic aspects of family life with seven young children, as stated by Baldwin in an Instagram video.
Hilaria and Baldwin will mark their 12th wedding anniversary in Manhattan at the end of the month, despite Baldwin being indicted on involuntary manslaughter charges earlier this year and listing their Hamptons estate for $18 million.
Baldwin bought the mansion in 1996 for $1.75 million and has tried to sell it several times in the last two years, initially listing it for $29 million, then reducing it to $25 million before finally settling below $20 million.
Alec Baldwin, in addition to his seven children with wife Hilaria, also has a daughter, Ireland, from his previous marriage to Kim Basinger. Last year, Ireland gave birth to a baby girl, making Baldwin a first-time grandfather.
