Can Jay-Z potentially be charged with sexual assault?
At the 2000 VMAs after-party, Jay-Z and Sean 'Diddy' Combs were accused of raping a 13-year-old.
According to legal experts, it is unlikely that Jay-Z will be charged with a crime related to the alleged rape of a 13-year-old.
An amended complaint has accused Jay-Z and friend Sean "Diddy" Combs of raping a young girl in 2000, but the statute of limitations for filing a criminal complaint has since expired.
"According to former federal prosecutor Neama Rahmani, Jay-Z is unlikely to face criminal charges unless there are new allegations. The statute of limitations for rape in New York was five years in 2000, which didn't start until the victim turned 18 or when the perpetrator left the state."
"The removal of the statute of limitations for rape in New York in 2006 was not retroactive, as it would violate the ex post facto clause of the Constitution. Therefore, when Jay-Z advises the victim and Buzbee to file criminal charges, it is a red herring."
An anonymous accuser has refiled a lawsuit against Jay-Z in New York, alleging that he raped her at a VMAs after-party in 2000 while Diddy and "celebrity B" watched.
Shawn Carter, better known as Jay-Z, urged the woman's lawyer to submit a criminal complaint rather than a civil one in response to the accusations.
"Jay-Z's lawyer received a blackmail attempt in the form of a demand letter from a lawyer named Tony Buzbee, according to a statement posted online by Roc Nation's X account. The nature of the allegations and the public scrutiny made Jay-Z feel compelled to settle."
"I will not give you one red penny, as it had the opposite effect and made me want to expose you as a fraud in a very public manner!"
Jay-Z urged, 'These allegations are so heinous that I urge you to file a criminal complaint, not a civil one. Whoever would commit such a crime against a minor should be locked away. The alleged victims would deserve real justice if that were the case.'
To proceed with the case, it is necessary for Jay-Z to be accused of the crime by either Diddy or "celebrity B," who allegedly witnessed the rape, according to a legal expert.
"Oleg Nekritin, a defense attorney at the Law Offices of Robert J. DeGroot, stated that the complaint against Jay-Z is devoid of concrete allegations. The plaintiff herself acknowledges that despite escaping the sexual assault, no other guests were aware of her distress or immodesty."
"Nekritin stated that the New York Southern District Attorney's Office is made up of top-notch prosecutors and investigators, and that a case wouldn't be pursued solely on the basis of an unproven and unconfirmed allegation."
If a "reliable witness to the assault" testifies or Jay-Z makes an admission, criminal charges could be filed, according to Nekritin.
If the plaintiff can provide medical or written records indicating that she disclosed the alleged assault to medical professionals shortly after the incident, she may have a chance of success in the civil matter, the legal expert stated.
"Mr. Carter's firm denials of the accusations against him and refusal to settle the case indicate that he considers the complaint to be a "shakedown" and a frivolous attempt to extort him. The mere accusation of such behavior can harm an individual's reputation. However, as Jay-Z once said, "whatever problems he may have, a criminal complaint won't be one.""
The 13-year-old girl was dropped off at Radio City Music Hall by a friend to attend the MTV Video Music Awards in 2000. She tried to enter the venue by approaching limousine drivers waiting outside the celebrity-filled event.
"The lawsuit stated that one of the limousine drivers she spoke to said he worked for Diddy and told her that Combs preferred younger girls. He also said she fit what Diddy was looking for, but did not allow her into the Awards, but invited her to an afterparty."
Upon arrival at the party, the 13-year-old recognized many celebrities but was not given a copy of the nondisclosure agreement.
The 13-year-old girl, after allegedly consuming one drink, became disoriented and found a bedroom to rest in. Jay-Z, Diddy, and female "celebrity B" appeared to follow the girl into the room. According to the court document, she immediately recognized all three celebrities.
The court document stated that Jay-Z allegedly raped the girl, followed by Diddy's alleged rape of the plaintiff, all while "celebrity B" watched.
At the time, Diddy would have been 30 years old. He allegedly tried to make the girl perform oral sex on him. However, she hit him in the neck, causing him to stop.
On Dec. 9, Jay-Z's legal team filed a motion to dismiss the lawsuit, which was filed one day after the amended complaint.
Diddy has been under investigation for human trafficking since March, while Jay-Z faces no criminal charges at this time.
Diddy was indicted on charges of racketeering conspiracy, sex trafficking, and transportation to engage in prostitution. If convicted, he could face a minimum of 15 years in prison or life imprisonment. Despite his claims of innocence, Diddy is facing serious consequences.
According to an unsealed indictment obtained by Planet Chronicle Digital, Diddy allegedly ran a criminal enterprise through his businesses, including Bad Boy Entertainment, Combs Enterprises and Combs Global, among others. He used "firearms, threats of violence, coercion and verbal, emotional, physical, and sexual abuse" to fulfill his sexual desires.
Diddy's criminal charges do not relate to this specific civil lawsuit.
"According to Judie Saunders, a former New York City prosecutor, federal prosecutors involved in Sean Combs' case have stated that their investigation is ongoing. As a result, there is always a possibility that other individuals could be charged with criminal offenses."
