The Texas appeals court upheld the lower court's decision to prevent the state from investigating parents who give their children gender-transitioning treatment.
In March 2022, a district court judge in Austin issued an injunction, which was upheld by the appeals court, preventing the investigation of families whose children were receiving puberty blockers, as ordered by Republican Governor Greg Abbott.
On Friday, the American Civil Liberties Union (ACLU) wrote on X, formerly Twitter, that this victory for trans youth and those who support them is much-needed.
The ACLU and Abbott's office were contacted by Planet Chronicle Digital for further comment.
The family of a 16-year-old transgender girl was initially represented by the ACLU and Lambda Legal in their challenge to Abbott's order.
Her mother, a DFPS employee, was put on administrative leave due to Abbott's directive after she had given her daughter puberty-delaying medications and hormone therapy.
In March 2022, Judge Amy Clark Meachum ruled that the plaintiffs in the case were being deprived of their constitutional rights, potentially losing necessary medical care, and facing the stigma of being the subject of an unfounded child abuse investigation.
Meachum believed that Abbott had overstepped his authority in the initial February order.
This month, a Texas judge temporarily halted Attorney General Ken Paxton's mandate for an LGBTQ+ advocacy group to disclose details about transgender kids undergoing gender transition therapy.
PFLAG National, an LGBTQ+ advocacy group, challenged Paxton's office in court to prevent it from collecting information. The ruling came shortly after.
Judge Maria Cantú Hexsel of Travis County District Court stated that disclosing the information would harm PFLAG and its members in several ways, including infringing upon their rights to free speech, assembly, and protection from unreasonable searches.
