The RNC is suing the NCSBE for allegedly allowing non-citizens to vote in North Carolina.

The lawsuit filed by the RNC and the North Carolina Republican Party in Wake County last week claims that the NCSBE and its members, Alan Hirsch, Jeff Carmon, Siobhan Millen, Stacy Eggers IV, and Kevin Lewis, have violated the Help America Vote Act (HAVA) by not requiring identification to prove citizenship. The lawsuit alleges that this failure to verify the identification of approximately 225,000 voters has opened the door for non-citizens to vote.

North Carolina is the first state in the country to begin voting. The battleground state will start mailing out ballots to eligible voters on September 6th. RNC Chairman Michael Whatley stated, "The NCSBE has once again failed in its mandate to keep non-citizens off the voter rolls, fueling distrust and jeopardizing our elections." He added, "We are committed to the basic principle – and commonsense law – that only Americans decide American elections. Deliberately failing to follow the law, right before our country’s most important election, is inexcusable. We will fight every day to ensure that NCSBE follows the law, cleans the voter rolls, and protects the vote for North Carolinians."

"The NCGOP Chairman Jason Simmons stated that the State Board has been unable to ensure that voter rolls only contain verified citizens. He added that this lawsuit aims to address the board's ongoing refusal to collect the necessary information from those who wish to participate in North Carolina elections. Simmons emphasized the need for accountability and adherence to the rule of law, particularly in the most partisan Elections Board in the state's history."

The state board's voter registration form did not require HAVA-required identification information, such as a driver's license number or the last four digits of a Social Security number. As a result, approximately 225,000 people registered without providing this information, according to the complaint.

The defendants allegedly failed to take corrective action and did not contact these voters to obtain the necessary information. Instead, they propose a weak solution that assumes those who were mistakenly registered will remove themselves from the voter list during other election-related activities, according to the complaint.

"The lawsuit states that the inaction fails to address ongoing violations of state and federal law and the defendants' responsibilities under the same, leaving North Carolinians questioning the security of their elections, especially when those responsible for protecting their rights are not taking the necessary steps to do so."

This "solution" sends a message to the millions of qualified and registered voters in North Carolina that their chief elections officials will neglect their duties and fail to verify if those who vote in the state's elections are eligible.

The NCSBE did not immediately respond when Planet Chronicle Digital contacted them for comment.

In a matter of weeks, the RNC and NCGOP have filed a second lawsuit against the North Carolina Board of Elections.

The board was sued by Republicans last month for not verifying jury questionnaire responses and removing non-citizens from the voter rolls, as mandated by law.

Despite the state legislature passing SB747, a major election integrity law in July 2019, the RNC and NCGOP allege that election officials have not started enforcing it.

In February, it was reported by North Carolina's Office of State Budget and Management that around 325,000 "unauthorized" immigrants were living in the state.

According to the complaint in that case, out of the 501,000 foreign-born non-citizens in North Carolina, that was the number.

Robert F. Kennedy, Jr. sued the North Carolina State Board for not removing his name from the state's ballot, even though he had dropped out of the race and endorsed Trump. Despite his request, the board voted 3-2 to keep his name on the ballots because over 2 million ballots had already been printed.

In Michigan and Wisconsin, Kennedy was unable to remove himself from the ballot.
