The Biden-Harris administration suffered a legal defeat at the hands of a conservative government watchdog group, who forced the Centers for Disease Control and Prevention (CDC) to stop deleting employee emails that were allegedly in violation of the Federal Records Act.

In February 2023, America First Legal, a right-leaning public interest organization founded by former Trump adviser Stephen Miller, requested records regarding the CDC's endorsement of gender ideology in public schools. However, the CDC informed AFL that it routinely deletes the emails of most employees 30 days after they leave the agency.

The National Archives and Records Administration (NARA) must now, under a preliminary injunction, seek the assistance of Attorney General Merrick Garland and inform Congress to retrieve the deleted emails and cease the destruction of records, as of Friday.

The AFL stated in a news release that while the Biden-Harris administration has faced criticism for breaking the law, CDC employees' homes were not searched or raided without prior notice or consent, and their families have not had to deal with the trauma and financial burden of legal fees or indictments.

The Biden-Harris Administration took action against President Trump by circumventing the law and subjecting innocent civilians to invasive and unlawful political persecution for expressing their opinions. This two-tiered justice system in the United States has become increasingly prevalent, the group stated.

The Biden-Harris Department of Health and Human Services (HHS) and NARA were sued by AFL in April.

Gene Hamilton, AFL executive director, stated that the Biden-Harris Administration was illegally destroying CDC employee records and that the U.S. District Court for the District of Columbia has put a stop to their actions.

NARA was contacted by AFL requesting an investigation into the CDC's email deletion policy.

According to AFL, NARA investigated allegations but ultimately determined that because the CDC instructs individual email account holders to apply retention based on the email's content value and applicability to a NARA-approved records schedule, NARA considered the matter closed. In essence, NARA delegated the decision of which emails can be automatically deleted to individual CDC employees.

The CDC has been criticized for its influence in the public, particularly during the pandemic era, where it reportedly had a significant impact on social media policies at Facebook and Instagram, and worked to suppress dissent regarding the COVID vaccine.

During the summer House Oversight Select Subcommittee on the Coronavirus Pandemic hearing, Dr. Anthony Fauci, former Director of the National Institute of Allergy and Infectious Diseases, denied any attempt to suppress the theory that the COVID-19 pandemic originated from a lab leak in Wuhan, China.
