On Saturday, the Washington Post's editorial board published a scathing article condemning Pennsylvania Democrats for supporting the counting of invalid ballots in the U.S. Senate race recount.
Democrats are attempting to save invalid provisional ballots for Sen. Bob Casey in an effort to overturn the election loss to Republican Senator-elect Dave McCormick.
Pennsylvania law triggered an automatic recount because the margin between the two candidates was less than half a point, and Casey lost by a margin of around 24,000 votes.
In some Pennsylvania counties, Democrats have voted to count ballots that were deemed invalid, despite a ruling by the state Supreme Court that such ballots should not be counted.
Bucks County Commissioner Diane Ellis-Marseglia, a Democrat, stated on Thursday that precedent set by a court is no longer relevant in this country.
""If I violate this law, it's because I want a court to pay attention. There's nothing more important than counting votes," she added."
The WaPo editorial board wrote that election rules "should be applied equally and consistently" in a piece titled "Democrats thumb their nose at the rule of law in Pennsylvania."
"The board stated that if a Republican commissioner made the same statement as Ellis-Marseglia to justify favoring their party's Senate nominee, Democrats would certainly protest, and their actions would be justified. The board emphasized the need for rules to be established before elections and for these rules to be applied equally and consistently."
The op-ed predicted that the votes will likely be overturned on appeal, but the attempt to challenge judicial rulings is harmful to democracy and may encourage similar behavior in future elections.
"The Pennsylvania Supreme Court has five justices elected as Democrats and two elected as Republicans. Even if the partisan balance were reversed, the court's authority would still be legitimate."
The op-ed asserts that Casey likely lost the race and advises Democrats to accept their defeat with dignity, "particularly if they want to maintain their image as the party of democracy."
"Although state law allows Mr. Casey to request a statewide recount due to Mr. McCormick's narrow margin of victory, it is unlikely to alter the final outcome."
