Trump verdict in E. Jean Carroll defamation case is upheld by US appeals court.
A Trump representative criticized the decision as an instance of "politicizing our justice system."
On Monday, a federal appeals court upheld the jury's verdict that Donald Trump was liable for sexually abusing E. Jean Carroll in the 1990s, dealing a blow to the president-elect and leaving him responsible for the $5 million payout ordered by the jury.
The three-judge panel for the U.S. Court of Appeals for the Second Circuit ruled Monday that Trump had not proven any errors in the district court's rulings and had not shown that any claimed errors affected his substantial rights, thus failing to warrant a new trial.
A New York jury determined that Trump was responsible for sexually assaulting Carroll, a former Elle magazine advice columnist, in a Bergdorf Goodman store dressing room in the mid-1990s, as well as for defaming her when she disclosed her story during his first term in office.
Trump was ordered by a jury to pay Carroll more than $80 million in damages for defamatory statements made during his first term in the White House, but the appeal of that decision is still pending.
The decision was praised by Carroll’s attorney, Roberta Kaplan.
"We are pleased with today's decision," Kaplan stated. "We appreciate the Second Circuit's thorough examination of our arguments."
The Trump transition team promptly reacted to the decision on Monday and pledged to challenge it. They also accused the courts of using their power for political purposes.
President Trump has been re-elected by the American People with a massive mandate, and they expect an immediate end to the politicization of our justice system and the dismissal of all witch hunts, including the Carroll Hoax, which will continue to be appealed, according to Steven Cheung, Trump's transition spokesman and incoming White House communications director, in a statement to Planet Chronicle on Monday.
Cheung stated that he looks forward to the country coming together under the new administration as President Trump works to make America great again.
