Trump's request for sentencing delay in Judge Merchan's case is denied.
Judge Merchan has denied the defendant's request for a stay.
Judge Juan Merchan of New York rejected President-elect Donald Trump's plea to postpone the verdict in the New York v. Trump lawsuit.
Merchan denied the defendant's request for a stay of the proceedings, including the scheduled sentencing hearing on January 10, 2025.
On Monday, Trump's legal team filed a motion to postpone his sentencing in the case, which is scheduled for Friday, January 10, at 9:30 a.m., nine days before his inauguration as the 47th president of the United States on January 20.
On Monday morning, Trump spokesman and incoming White House communications director Steven Cheung stated that President Trump's legal team had filed a motion to halt the unjust sentencing in the Manhattan D.A.'s Witch Hunt. The Supreme Court's landmark decision on Immunity, the state constitution of New York, and other established legal precedents mandate that this baseless case be dismissed immediately.
President Trump was elected by the American People with a strong mandate to put an end to the politicization of our justice system and the ongoing witch hunts. Cheung stated that the country would come together under the new administration as Trump works to make America great again.
The president-elect will not be sentenced to prison, but instead will receive an "unconditional discharge," meaning no punishment will be imposed.
In May, Trump was convicted of 34 counts of falsifying business records in Manhattan, with Manhattan District Attorney Alvin Bragg's office proving that Trump falsified records to hide a $130,000 payment to Stormy Daniels before the 2016 election to suppress her claims of an affair with Trump in 2006.
Trump has consistently denied any wrongdoing in the case and has repeatedly criticized it as an instance of Democrats using "lawfare" to harm his election prospects before November.
"Legal scholars and pundits agree that there is no case against me. The judge fabricated the facts and law, just like other New York judicial and prosecutorial witch hunts. As a result, businesses are leaving New York, taking millions of jobs and billions of dollars in taxes. The legal system is broken, and businesses can't risk getting caught up in this quicksand. This case is rigged against my political opponent, me!" Trump posted on Truth Social on Sunday evening.
