The Harris campaign is maintaining its stance on ending cash bail and implementing bail reform, with the vice president and former prosecutor under fire for past policies and views on crime and law enforcement.
According to James Singer, a spokesperson for the Harris campaign, Vice President Harris believes that our criminal justice system should provide equal protection and service to all Americans, regardless of their economic status, gender, or race.
Singer advocates for a bail system that prioritizes public safety over wealth, stating that anyone who poses a threat to society should be detained, regardless of their financial status.
As district attorney in San Francisco, California attorney general, and U.S. senator, Harris' stance on cash bail has fluctuated.
In 2019, Harris made her stance on running for president a little more assertively.
"Our bail system is unjust and broken. End money bail," wrote Harris on Medium.
"Over 450,000 Americans are currently incarcerated, awaiting trial due to inability to pay bail. The use of excessive cash bail disproportionately affects low-income and minority communities," she stated.
Similarly-situated White defendants are more likely to be released before trial and able to post bail compared with Black defendants, who pay higher bail.
During her first 100 days as a DA, she stated that one of her top priorities would be to increase the cost of bail, according to the Washington Free Beacon.
"Harris stated in an interview that his daily priorities involve discussing with his chief assistant, Russ Guintini, the need to change the bail schedule in San Francisco. He explained that they are currently working on requesting the bench and judiciary to reevaluate the current bail system, which requires arrested individuals to pay significantly less than in other counties."
She remarked that people were coming to San Francisco to commit crimes because it was more affordable there.
"We must address that issue," she stated. "That's where my focus lies."
In 2014, while serving as attorney general, Harris' office opposed the release of nonviolent offenders, citing the desire to keep them for low-cost labor, according to the Washington Examiner.
The lawyers from Harris' office wrote in a filing that extending 2-for-1 credits to all minimum custody inmates would have a severe impact on fire camp participation, which could be a dangerous outcome during California's difficult fire season and severe drought.
Eliminating cash bail is often viewed as a forward-thinking approach to criminal justice. However, research indicates that this reform, which has been implemented in states such as New York, can result in higher recidivism rates.
In February, the Data Collaborative for Justice found that eliminating money bail led to an increase in recidivism among individuals charged with nonviolent felonies, those with a recent violent felony arrest, and those with a recent criminal history, while it decreased recidivism among people charged with misdemeanors and those with no recent criminal history.
Some critics have accused Harris of frequently changing her stance on contentious policies in order to boost her political standing.
A California public safety official who was once elected, criticized Harris for her role in promoting the state's infamous crime law, stating that her claimed ability to combat drug and violent crime was "all hype and no substance."
A former official told Planet Chronicle Digital that her principle is not to take a position because she is uncertain about how it will affect her future.
The Trump campaign is describing the removal of cash bail as a "disaster."
