Trump's Attorney General Nominee Resigns from House Amid Ethics Report Release
Rep. Matt Gaetz, R-Fla., resigned from Congress on Wednesday, just hours after President-elect Trump nominated him for U.S. Attorney General, and before a long-awaited House Ethics report on him was reportedly set to be released.
On Wednesday, after it was reported that Gaetz was appointed to the Trump Cabinet, Rep. Michael Guest, R-Miss., stated that their investigation into Gaetz's alleged sexual misconduct with a minor and drug use would conclude if he resigned from Congress.
Gaetz has denied those misconduct allegations.
In the Capitol, Guest stated that Gaetz's nomination would not affect anything.
"Assuming that Mr. Gaetz is still a member of Congress, the Ethics Committee will issue a report once the investigation is complete. However, if Mr. Gaetz resigns to take a position as the attorney general, the committee loses jurisdiction and a unique report will not be issued."
The committee's investigation was temporarily halted by the Justice Department's request to "cease and desist," but the House has since resumed it.
Punchbowl News first reported that the committee was scheduled to vote on releasing the ethics report on Friday.
According to a Republican source, the New York Times reported that the report was delayed due to a House rule that prohibits releasing negative findings prior to an election. Gaetz, who played a key role in the ouster of former House Speaker Kevin McCarthy, R-Calif., was pleased to see him go, as were dozens of other Republican lawmakers who had been tipped off about his resignation before it was officially announced Wednesday night, Politico reported.
An anonymous House Republican source told Politico that Gaetz is resigning from Congress to impede the impending ethics investigation, which will be released in a week.
Johnson stated at a press conference on Wednesday that Gaetz had resigned abruptly in order to speed up the process of filling his House seat through a special election.
Republicans retained control of the House in the recent election, ensuring a unified government with the White House, but there are worries about the slim margin, as Trump appoints House Republicans to his new administration.
Johnson expressed optimism about replacing Gaetz before the House selects a new speaker on Jan. 3, but it is uncertain if state and federal laws will allow for the quick turnaround.
"Johnson stated that he received a resignation letter from Congress, which was effective immediately. This came as a surprise to him, but he asked for the reasoning behind it. The individual explained that there are too many absences allowed under Florida State law, which has an eight-week period to fill a vacancy. Johnson then placed a call to Governor DeSantis in Florida to start the clock. The governor is currently in Italy, and they will discuss the matter first thing in the morning."
"If we start the clock now, we may be able to fill that seat as early as Jan. 3 when we take the new oath of office for the new Congress," Johnson said. "Matt made a great decision on the fly, and we're grateful for it."
House Majority Leader Steve Scalise, R-La., stated earlier Wednesday that Trump's decision to nominate Gaetz as attorney general is a strong statement that the weaponization of government, particularly by the Biden administration against political enemies, is coming to an end. He added that the party is over and they will clean up the mess at the Department of Justice.
Despite Politico's report that several Republican senators were uncertain about Gaetz's confirmation as attorney general, these doubts seemed to persist in the House.
"Rep. Max Miller, R-Ohio, stated that all of the president's selections have been made with intent, respect, and integrity, except for Rep. Gaetz, whom he believes is a loyal soldier but will never be confirmed by the Senate. He believes that the president is smart enough to know that Gaetz will never be confirmed and that he will be excoriated by members of the Senate on both sides of the aisle due to his lack of teamwork and help to the conference."
