The Democratic National Convention will vote on the 2024 policy platform on Monday, which includes explicit Title IX protections for LGBT students that were recently blocked by the Supreme Court.
The Democratic National Convention unveiled the final 2024 Democratic Party platform on Sunday night, following the previous version created during President Joe Biden's reelection campaign, which was eventually abandoned. Vice President Kamala Harris subsequently declared her own presidential bid, necessitating revisions that aligned with her own policy views and a new vision for the party. The updated platform mirrors the Biden administration's efforts to expand the definition of sex discrimination under Title IX to encompass gender identity.
"The Biden-Harris Title IX rules are in effect in less than 50% of the country after Friday's SCOTUS order, highlighting the lawlessness of this policy and the deep unpopularity of this issue, as Nicole Neily, the president and founder of parental rights group Parents Defending Education, told Planet Chronicle Digital. However, opposition to progressive gender policies is one of the few issues that unites Americans across racial, political, and socioeconomic lines, so doubling down on this issue could be a risky move."
Matt Sharp, a senior counsel at Alliance Defending Freedom, a Christian nonprofit that also focuses on parental rights issues, stated that the decision to include transgender protections in the Democratic Party's platform contradicts the growing public opinion about broadening the scope of sex discrimination to encompass gender identity.
Sharp expressed concern about the DNC platform continuing to follow the same path that courts have repeatedly rejected and that the American public does not support.
The effort to redefine sex and sexual discrimination has a long history, dating back to President Barack Obama's administration. After Trump took office, he reversed the rule, but it was reinstated by Biden.
Sharp stated that this pattern has been repeated across multiple administrations, but both the courts and the American public are rejecting it, and we are witnessing more courageous female voices speaking out against it.
Stephen Miller, the founder of America First Legal, a right-wing legal organization, dismissed the move to safeguard transgender students under Title IX as outdated.
For over a decade, the left has tried to change Title IX in Congress but has failed repeatedly. They have also attempted to change the law through administrative fiat twice. To protect girls' sports, bathrooms, and locker rooms, the Trump administration reversed the Obama administration's 'Dear Colleague' letter that asserted 'sex' and 'gender identity' are coextensive.
The Trump administration's Title IX rule, which survived all left-wing court challenges, has been upheld by the Supreme Court. The Biden-Harris administration tried to rewrite the statute through regulation, but the courts have stopped this attempt. The Supreme Court has ruled that the word 'sex' in Title IX refers to biological sex, male or female, and not gender identity.
The Harris campaign did not respond to Planet Chronicle Digital's request for comment.
The DNC party platform includes language that states Democrats will continue to ease the burden of student debt for transgender students and others, while also accusing Republicans of hindering this effort.
The Supreme Court rejected the Biden administration's student debt cancellation plan last year, stating that the president exceeded his authority when he announced a $400 billion loan cancellation initiative through executive action.
