Despite ICE's ongoing requests, a Haitian migrant accused of raping a 15-year-old girl at a Massachusetts hotel was released on $500 bail last week.

In March, Cory Alvarez, a 26-year-old Haitian national who entered the US through a contentious parole program that permits up to 30,000 migrants to fly in monthly, was accused of aggravated rape of a child.

On March 14, Boston's ERO branch filed a detainer against Alvarez with the local sheriff's office, requesting ICE to take the individual into federal custody and deport them.

On June 27, Plymouth Superior Court did not adhere to the detainer request from ERO Boston and released Alvarez on bail. The Boston Globe reported that prosecutors had asked for bail to be set at $25,000, but the judge set bail at $500 on the condition that Alvarez submit to various stipulations, including home confinement and other forms of monitoring.

Alvarez was released following a three-part hearing that examined medical records, surveillance, and testimony, as stated by Brian A. Kelley, Alvarez's attorney.

Alvarez was released on bail after the video surveillance showed her entering the room and exiting eight minutes later, with her clothing undisturbed and no injuries found on the alleged victim, Kelley confirmed.

Additionally, he stated that Alvarez's bail conditions included home confinement and the surrender of his passport, which he complied with. Furthermore, he emphasized a Massachusetts court ruling that lacked the authority to detain an individual based solely on an ICE detainer.

Kelley added, "I hope all Karen Read supporters have found a new cause to support, namely the innocence of Cory Alvarez."

Alvarez entered the US in June under the parole process for Cubans, Haitians, Nicaraguans, and Venezuelans (CHNV). The policy was initially announced for Venezuelans in October 2022, allowing a limited number to fly directly into the US as long as they had not entered illegally, had a sponsor in the US already, and passed certain checks.

In January 2023, the administration announced that the program would be expanded to include Haitians, Nicaraguans, and Cubans, allowing up to 30,000 people per month to enter the U.S. The program provides migrants with work permits and a two-year authorization to live in the U.S. This expansion was announced alongside an expansion of Title 42 expulsions to include those nationalities.

The parole process, which the Department of Homeland Security describes as a "safe and orderly way to reach the United States," is a "key element" of the administration's efforts to address high levels of migration throughout the hemisphere. However, Republicans have accused the administration of abusing the parole process with the program.

Since January 2023, over 138,000 Haitians have been brought into the U.S. by the CHNV parole program, according to official data.
