Schumer's lame-duck effort to secure a Dem majority on the top labor board faces opposition from Manchin and Sinema.
Trump was criticized for not being allowed to make his own choice during the last-minute vote scheduled by Schumer.
President Biden and Senate Democrats attempted to confirm National Labor Relations Board Chair Lauren McFerran, a Democrat, for another five-year term, in an effort to maintain a Democrat majority on the board until the start of President-elect Trump's term.
On Wednesday afternoon, Senate Majority Leader Chuck Schumer, D-N.Y., failed to predict Trump's impact on labor and unions during the first two years of his term.
The test vote was defeated by Senators Joe Manchin and Kyrsten Sinema, both from the Democratic caucus.
Despite the Democrats' effort, McFerran was not re-confirmed on the floor. Her nomination has been waiting to be considered since August when Democrats advanced her out of the Senate Committee on Health, Education, Labor and Pensions (HELP). The Democrats have a razor-thin majority of only 51, and ensuring all senators are present to vote can often be challenging.
Against ending debate and proceeding to a vote on her re-confirmation, the senators voted 50 to 49.
Republicans were frustrated that HELP Chairman Bernie Sanders, I-Vt., refused to hold a public hearing on McFerran before advancing her, as requested by Ranking Member Bill Cassidy, R-La.
"President Trump should fill the NLRB seat with a historically popular president and a Senate Republican Majority that has been elected to govern," Cassidy said in a statement. "I am glad the Senate rejected Democrats’ partisan attempt to deny President Trump the opportunity to choose his own nominees and enact a pro-America, pro-worker agenda with the mandate he has from the American people."
On Monday, Schumer filed cloture on her nomination, which will result in a vote on Wednesday. In her floor remarks, the New York Democrat did not mention the lame-duck nature of the vote. Instead, she emphasized the importance of advancing the NLRB nominees, stating, "If you truly care about working families and income inequality in America, then you should support the NLRB nominees. You cannot claim to be for working families and then vote no, as the NLRB safeguards workers from mistreatment and overzealous employers."
The chair of the NLRB, Lauren McFerran, is responsible for implementing the Biden-Big Labor agenda and is up for confirmation to another term.
He added, "Her confirmation would give a lame-duck President control of an independent board well into his successor's term!"
During his term, Trump will have the opportunity to fill the position since McFerran was not re-confirmed.
Trump's transition team did not immediately provide comment to Planet Chronicle Digital.
Charlie Kirk, founder and CEO of Turning Point USA, issued a warning on Monday about Schumer and Biden's attempt to reappoint Lauren McFerran as chair of the National Labor Relations Board. If successful, McFerran would serve as the Democratic chair of the NLRB for the first two years of Trump's presidency. Kirk urged every Republican senator to show up and block her appointment.
