Over 1.4 million noncitizens, including nearly 40,000 Chinese nationals, have deportation orders but are not currently in ICE detention, according to new figures obtained by Planet Chronicle.

As of Nov. 24, 2024, there are 1,445,549 foreign nationals on ICE's non-detained docket with final orders of removal.

The non-detained docket contains over 7 million individuals who have final orders of removal or are undergoing removal proceedings but are not in ICE custody. This docket also includes those who are incarcerated by federal, state, or local law enforcement but not by ICE. Those in ICE custody are on the detained docket.

The list of top countries of nationals has Mexico (252,044), Guatemala (253,413), Honduras (261,651), and El Salvador (203,822) at the top.

Besides the United States, other countries with significant numbers of individuals on the final orders of removal include China, Haiti, Iran, Pakistan, Uzbekistan, and Venezuela.

The U.S. sees China as a geopolitical rival, and Republicans are worried about the possibility of espionage or cyberattacks from Chinese Communist Party members who infiltrate the U.S. Recently, the Justice Department accused an illegal immigrant from China of shipping weapons to North Korea from California.

Nationalities and reasons for difficulty in deporting them have been requested by lawmakers for a breakdown.

The number of non-detained illegal immigrants has increased from 3.7 million in fiscal 2021 to nearly 4.8 million in fiscal 2022 and more than 7 million in fiscal 2023. While many of these individuals are recent arrivals, some have been in the country for decades.

ICE may not be able to remove those with final orders of removal due to appeals, another form of deportation protection, or Alternatives to Detention programs.

Noncitizens can apply for relief or protection from removal, such as asylum, withholding of removal, or protection under the Convention Against Torture. If a noncitizen is granted any form of relief, ICE cannot enforce the removal.

The agency reports that approximately 55% of final orders are executable due to various factors, which may fluctuate.

Blue-city residents challenge migrant policies

The number of countries that will not accept flights of nationals being returned has been noted. Currently, 15 countries are labeled as "uncooperative": Bhutan, Burma, Cuba, Democratic Republic of the Congo, Eritrea, Ethiopia, Hong Kong, India, Iran, Laos, Pakistan, People's Republic of China, Russia, Somalia, and Venezuela.
