If Casey continues to refuse to concede, Lee threatens to withhold his seat in the Senate.
Casey has declined to accept the election results.
Sen. Mike Lee, R-Utah, criticized Sen. Bob Casey, D-Pennsylvania, for not conceding the election, stating that the Senate could refuse to seat him if he persists in relying on "illegal votes."
"If Bob Casey does not concede, Pennsylvania will continue to count illegal votes, and he will rely on those votes to claim victory. As a result, the Senate may refuse to seat him, according to Article I, Sec. 5, Cl. 1, which states that each House shall be the judge of its own members' elections, returns, and qualifications."
Pennsylvania’s Senate race will be decided by a recount after Sen.-elect Dave McCormick won the election by approximately 26,000 votes, which is within the one percentage point margin that triggers an automatic recount under Pennsylvania law.
Despite multiple outlets calling the election, Casey has refused to concede and is insisting on waiting for all votes to be counted before declaring a winner.
Officials in Philadelphia and surrounding Bucks and Montgomery counties are ignoring the Pennsylvania Supreme Court's ruling that ballots without required signatures and dates cannot be included in official results, despite the ongoing debate about the votes Casey is trying to count.
"Bucks County Commissioner Diane Ellis-Marseglia, a Democrat, stated last week that precedent set by a court is no longer relevant in this country. "People disregard laws at their convenience," she said. "For me, if I break this law, it's to draw attention to the court. There's nothing more crucial than vote counting.""
Michael Whatley, the Republican National Committee Chairman, has criticized Democrats in Pennsylvania for allegedly trying to "steal" the election from McCormick.
Democrats in Pennsylvania are attempting to illegally count ballots in an effort to steal a senate seat, as stated by him on X.
Meanwhile, Lee has urged Casey to abandon the fight over the ballots and allow McCormick to take his seat in the Senate.
"Lee stated in a post on X that Bob Casey is better than his current actions and it's time to concede."
The Casey campaign declined to comment on a Planet Chronicle Digital request.
