On Monday, a Pennsylvania judge ruled that Elon Musk's America PAC can continue its $1 million a day contest until November 5th.
Hours after Philadelphia District Attorney Larry Krasner's testimony against America PAC on Monday, Common Pleas Court Judge Angelo Foglietta ruled that the "sweepstakes" violates election laws and ordered it to be shut down.
On Monday, Krasner testified that the competition was a scam.
The district attorney stated that this was merely a political advertising campaign disguised as a lottery.
It seems that the America PAC giveaway winners are not chosen randomly, but rather through a contest where voters in swing states sign a petition to win $1 million.
On Monday, Attorney Chris Gober stated that the giveaway winners were chosen based on the personal narratives they shared and that they all signed nondisclosure agreements.
"Chris Gober, America PAC attorney, stated in court on Monday that the $1 million recipients are not randomly selected. Instead, they are chosen with precision, and the recipients for today and tomorrow are already known."
The America PAC's contest awards $1 million to a swing state voter daily until Election Day, as announced by Musk in October at a rally for former President Trump on Oct. 19.
Musk announced at the campaign event that a million dollars would be awarded daily to petition signers until the election, but in a post on X the next day, he did not specify that the selection was random.
"From now until Nov 5, @America PAC will be giving away $1M to someone in swing states who signed our petition to support free speech & the right to bear arms!" Musk's post stated. "We want to ensure that everyone in swing states is aware of this and I believe it will encourage them to take action."
On Monday, Kranser expressed concern about the data shared by contest participants.
"Krasner argued that their information was scammed and it has almost unlimited use."
