A federal judge has paved the way for the publication of the special counsel's report on the Trump election case.
The report on classified documents will be decided on by Judge Aileen Cannon on Friday.
On Monday, a federal judge granted the release of the special counsel report on President-elect Trump's election interference case.
On Monday, Judge Aileen Cannon approved the release of the first volume of Special Counsel Jack Smith's investigation, and she will consider releasing the second volume, which pertains to Trump's handling of classified documents, on Friday.
Smith halted his probe of Trump after the president-elect won re-election in November.
Last week, Trump co-defendants Waltine Nauta and Carlos De Oliveira filed an emergency motion to prevent Cannon from releasing Smith's final report.
Nauta and De Oliveira's claims were considered by Cannon, who prohibited the release of the report.
Smith was temporarily prohibited from disclosing, distributing, or transmitting the Final Report or any of its drafts beyond the Department of Justice.
On Monday, she ruled against the pair, stating that there was "insufficient basis" to grant an injunction preventing the release of the report.
Special counsels typically release a final report detailing their investigation's findings and explaining any prosecution or declination decisions they made. However, in Smith's case, the prosecution decision is irrelevant due to Trump's status as president-elect and the longstanding Justice Department policy of not pursuing criminal charges against a sitting president.
Trump has blasted Smith's work as a "fake report.
Merrick Garland has decided to release the reports from two special counsels whose investigations were completed during his tenure, including John Durham's summary report on the Trump-Russia probe and Robert Hur's final report on President Biden's handling of classified documents.
